Essentials of a Wedding Photography Agreement
As much as wedding photography is about being a creative photographer making striking wedding images, it's also about running a business. This includes taking care of legalities such as a wedding photography agreement.

A wedding photography agreement will protect you from liability. It should also clearly stipulate expectations for both you and your clients to minimize the potential for miscommunication.
Many photographers have little idea what makes for a good wedding photography contract. The length and content will largely depend on the type of services you provide. Here are a few non-negotiable inclusions:
1. Introduction
The contract page holds the essential contact information for both parties making the agreement. Think of this as a cover page with basic contact information including:
* The clients' names and all contact information
* Description of service acquiring (for example, “6 hours of wedding photography services)
* Date, time, location of ceremony and reception.

This agreement is between Mia Rose Photography of (business address) and Mary Smith of (bride's address) and Bryan Grey (groom's address) for the purposes of providing photography services between (start time) and (end time) on (date) at (place of ceremony) and (place of reception).
2. Scope of Work
This specifies that the agreement was made by both parties who fully intend to stay within the boundaries of the agreement.

Mia Rose (the Photographer) shall provide photography services for Mary Smith and Bryan Grey (the Bride and Groom), consisting of:
(Add a detailed shot list or description of services, number of pictures, and/or package chosen by clients.)
3. Payment (including deposit or booking fee)
In a good wedding agreement, the total charge for services provided is transparent, including booking fees and reimbursement for travel in some cases. Include your policy about the deposit you require and whether the deposit is refundable.

The Photographer shall provide photography services as described above for the flat fee of (state fee). The Bride and Groom agree to pay to the Photographer a partial payment of (amount) no later than 60 (sixty) days prior to the wedding date. The Bride and Groom agree to pay the remaining balance of (amount) and any additional expenses as described below, no later than 7 (seven) days after the wedding date. In the event that the wedding is cancelled by the Bride and Groom for any reason, the Bride and Groom agree to forego return of the (amount) partial payment.
The Bride and Groom shall pay all food, beverages, and lodging costs for the Photographer with a cap of $200 (Two Hundred Dollars).
(Note: if all fees are due in advance, then say so. Make sure to include the exact amount, due date, return policy, additional expenses, and cancellation fee.)
4. Indemnification
This section covers the photographer in the event that something goes wrong:

The Bride and Groom shall indemnify and hold harmless the Photographer from any loss, damage or liability resulting from the Bride and Groom’s violation of the terms of this Agreement or any agreement involving the Bride and Groom and the Photographer. The Bride and Groom shall indemnify the Photographer and hold him/her harmless from and against any claim by any other person or entity resulting from the performance of their services under this agreement.
You may also want to include a clause about arbitration, for example:
Any dispute arising under or in any way related to this agreement shall be submitted to binding arbitration by (stipulate who will conduct the arbitration). The arbitration shall be conducted in (state the place, for example Melbourne). The arbitration shall be binding on the parties and the arbitration award may be confirmed by any court of competent jurisdiction.
5. Model release
If you plan to use the wedding images after the event in your portfolio and for marketing your services, or even for stock photos, you need to get a model release signed by the bride and groom.
6. Other
You may also want to include finer details such as the schedule for the day and a stipulation about being the sole photographer.
7. Signature Page
Make sure that the wedding photography agreement is signed by both parties and a witness. Include the date and place that the agreement is reached.

The execution of a signature page of this Agreement shall constitute the execution of the Agreement, and the Agreement shall be binding on each party upon the date of signature.
